Where Do You Have to Stop at a Red Light, and When Can You Turn?
What the law says: Vehicle Code 21453
The section is built around three signals:
- Steady circular red, subdivision (a). Stop at the marked limit line; if there is none, before entering the crosswalk on the near side; if there is none, before entering the intersection. Remain stopped until an indication to proceed is shown.
- Turning on a circular red, subdivision (b). Unless a sign prohibits it, after stopping as required, a driver may turn right, or turn left from a one-way street onto a one-way street. The driver must yield to pedestrians lawfully in an adjacent crosswalk and to any vehicle close enough to be an immediate hazard, and keep yielding until the turn can be made with reasonable safety.
- Steady red arrow, subdivision (c). Do not enter the intersection to make the movement the arrow shows, and stop at the same points until a signal permits that movement.
Subdivisions (d) and (e) cover pedestrians. Since 2023, an officer may not stop a pedestrian for entering against a red unless a reasonably careful person would realize there was an immediate danger of collision, and the same subdivision says drivers keep their duty of due care toward any pedestrian in the roadway.
What it means in practice
Two habits lead to red-light citations drivers did not see coming.
The rolling right turn. Subdivision (b) allows a turn on red only "after stopping as required by subdivision (a)." Slowing to walking pace and turning is not a stop. Neither is stopping past the limit line, in the crosswalk, with the nose of the car already in the intersection.
The red arrow. A red arrow is not a suggestion to turn carefully. Under subdivision (c), you may not make that movement at all until the arrow changes. People who turn on a red right arrow because they would be allowed to on a circular red are cited under this section.
The left-on-red rule surprises drivers too, in the other direction. Turning left from a one-way street onto another one-way street is permitted after a full stop, on the same terms as a right turn. It is not permitted from a two-way street.
| Situation | Allowed? |
|---|---|
| Right on circular red after a full stop, no sign | Yes, yielding to pedestrians and close traffic |
| Right on red with a "No Turn on Red" sign | No |
| Right on a red right arrow | No |
| Left on red, one-way onto one-way, after a stop | Yes, unless a sign prohibits it |
How a red-light violation counts
A conviction under section 21453 is a traffic conviction involving safe operation, which section 12810(f) values at one point. The DMV handbook describes traffic violator school as an option a judge may offer for a one-point violation, once in any 18-month period, so the citation is not reported to your insurance company though it stays on the record. Camera-issued tickets follow their own automated-enforcement procedures, which sit outside this section.
Collisions at signals are where the money is. When someone enters on red, the question of who was principally at fault is decided under the Insurance Commissioner's rules, and a driver whose actions were at least 51 percent of the legal cause is the one charged with the accident.
What to do
- Stop completely at the limit line, then creep forward only to see, and turn only when clear.
- Look for "No Turn on Red" signs and red arrows before you commit to the turn lane.
- Yield to anyone in the crosswalk beside you, including someone who stepped off late.
- If you are cited, ask whether traffic school is available and whether you have used it in the past 18 months.
- After a signal collision, note the signal phase, any cameras, and witnesses before leaving.
